When you use the Cyber Smart Seniors website, read our articles, listen to our podcasts, get our newsletters, or use any of our services, you agree to follow these rules. If you don't agree with these rules, please don't use our services.

2. Description of Service

Cyber Smart Seniors provides educational content and teaches seniors about staying safe online, avoiding scams, and using technology. We offer articles, newsletters, podcasts, checklists, and other helpful materials. Some content is free, and some requires a paid subscription.

3. Educational Purpose and Disclaimers

3.1 Educational Content Only

Everything we provide is meant to teach and inform you only. Cyber Smart Seniors does not offer professional computer help, technical support, financial advice, medical advice, or legal advice.

3.2 No Guarantee of Protection

IMPORTANT: While our educational materials aim to help you recognize scams and stay safe online, we cannot promise that following our advice will completely protect you from scams, cyber attacks, or other security problems. New scams appear all the time, and criminals are always finding new ways to trick people.

3.3 Technology Guidance Limitations

Our technology tutorials and device instructions are meant to teach you. We are not responsible if something goes wrong with your devices, if you lose data, if settings get messed up, or if other technical problems happen when you follow our instructions. Always save your important information and consider getting help from qualified technical support when making big changes to your devices.

3.4 Content Currency

Technology and cybersecurity information changes very quickly. While we try to keep our content up-to-date, we cannot promise that all information is current or complete. You should double-check information on your own and look at current sources before taking action.

3.5 Content Creation

Some of our content, including text, images, and audio materials, may be created or helped by artificial intelligence technology. While our staff and editors review all content for accuracy and quality, both AI systems and humans can make mistakes. We do not and will not tell you which specific content was created using AI versus human authors. You understand that AI-created content may contain errors and agree to use such content carefully.

5. Subscription Terms and Payment

5.2 Subscription Billing

  • Premium subscriptions are charged regularly (monthly, yearly, or every other year as you choose)
  • Payments will automatically continue unless you cancel before your renewal date
  • Fees cannot be refunded except as required by law

5.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Your cancellation will take effect at the end of your current billing period.

5.4 Account Sharing Restrictions

Your premium subscription account is for you alone. You may not share your login information with others or let multiple people use your account at the same time. Each subscription is for one person only. Breaking this rule may result in us immediately closing your account without giving you your money back.

5.5 Price Changes

We have the right to change subscription prices, but we will give existing subscribers at least 30 days' notice.

6. Intellectual Property Rights

6.1 Our Content

All content, including articles, podcasts, checklists, newsletters, images, logos, and educational materials, belongs to Cyber Smart Seniors and is protected by copyright and other laws. You may not copy, share, change, or create new works based on our content without our written permission.

6.2 Limited License

We give you limited permission to access and use our content for your personal, non-business educational purposes only.

6.3 User-Generated Content

When you submit comments, testimonials, or other content to our service, you give us permanent, worldwide permission to use, modify, and display that content in connection with our service.

6.5 Content Download and Sharing Rights

Checklists: You may download, save, print, and share our checklists for personal and educational purposes. We encourage sharing checklists as they may help others learn about cybersecurity and scam prevention.

Articles and Podcasts: Premium articles and podcasts are for your personal use only and may not be downloaded, copied, shared, or distributed in any way. This restriction helps us continue providing high-quality educational content to our subscribers. Our content creation processes, how we edit content, our artificial intelligence methods, content planning systems, how we engage subscribers, and other business methods are valuable trade secrets and private information of Cyber Smart Seniors. You agree not to try to figure out, copy, or discover these methods through use of our service. This includes but is not limited to our content organization systems, AI methods, editorial review processes, and subscriber conversion strategies.

7. Prohibited Uses

You agree not to:

  • Use our service for anything illegal or against these terms
  • Try to get unauthorized access to our systems or user accounts
  • Share your premium account login information with others
  • Copy, reproduce, or redistribute our premium content (except checklists as allowed)
  • Use automated systems to access our service without permission
  • Pretend to be someone else or give false information
  • Post or share content that is harassing, abusive, insulting, or inappropriate (in any current or future community features)
  • Make false, insulting, or harmful statements about Cyber Smart Seniors, our staff, or our services in any public place, social media, or review site

8. Limitation of Liability

8.1 No Warranties

Our service is provided "as is" without any promises or guarantees of any kind, including but not limited to promises that it will work perfectly, fit your particular purpose, or not violate anyone's rights.

8.2 Limitation of Damages

To the maximum extent allowed by law, Cyber Smart Seniors will not be responsible for any indirect, accidental, special, resulting, or punitive damages, including but not limited to:

  • Money you lose because of scams or cyber attacks
  • Damage to devices or loss of data from following our guidance
  • Business interruption or loss of profits
  • Personal injury or property damage
  • Any other losses, even if we knew these damages might happen

8.3 Maximum Liability

In no case will our total responsibility to you be more than the amount you paid for our service in the 12 months before your claim.

9. Indemnification

You agree to defend, pay for damages, and protect Cyber Smart Seniors, its officers, directors, employees, and representatives from any claims, damages, losses, or expenses that come from:

  • Your use of our service
  • Your violation of these terms
  • Your violation of anyone else's rights
  • Any content you submit to our service

10. Privacy and Data Protection

Your privacy is important to us. How we collect and use your personal information is explained in our separate Privacy Policy. We keep user data indefinitely for business purposes, and we use that data as we decide is appropriate according to privacy laws.

11. Service Delivery and Technical Issues

While we try to deliver content consistently, we do not promise uninterrupted access to our service. Technical problems, server maintenance, email delivery issues, or other factors may sometimes prevent or delay content delivery.

11.2 Force Majeure

We will not be responsible for any failure or delay in our service or in delivering articles, podcasts, newsletters, or other content that happens because of circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, government actions, internet service provider failures, or other uncontrollable events.

11.3 Content Accuracy and Updates

Because cybersecurity threats and technology change so rapidly, we cannot provide a way for users to report outdated information or promise that all content reflects the most current developments. Users should check information independently and understand that cybersecurity and technology situations change daily.

12. Beta Testing and New Features

From time to time, we may offer test versions of new features or content formats to select users. By participating in testing, you understand that such features may be experimental, may not work properly, and may be changed or stopped without notice. Test features are provided "as is" without additional promises.

13. Third-Party Services

Our service may contain links to other websites or work with other services (such as payment processors, podcast platforms, or social media). We are not responsible for the content, policies, or practices of these other services.

14. Termination

14.1 Termination by You

You may close your account at any time by following the cancellation procedures or contacting us.

14.2 Termination by Us

We may suspend or stop your access to our service at any time, with or without cause, including for violation of these terms.

14.3 Effect of Termination

When your account is closed, your right to access our service will stop immediately. Parts of these terms that should continue after termination will remain in effect.

15. Dispute Resolution

13.1 Governing Law

These terms are governed by the laws of Minnesota, without regard to conflict of law principles.

13.2 Jurisdiction

Any disputes that come from these terms or your use of our service will be resolved in the courts of Minnesota.

13.3 Arbitration

Any dispute, claim, or controversy that comes from these terms or your use of our service will be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be conducted by a single arbitrator in Minneapolis, Minnesota. The arbitrator's decision will be final and binding, and a court judgment may be entered based on it. You give up any right to a jury trial and agree that any arbitration will be conducted on an individual basis only (no class actions). This arbitration clause does not prevent you from bringing issues to the attention of federal, state, or local agencies, which can, if the law allows, seek relief against us on your behalf.

16. General Provisions

14.1 Entire Agreement

These terms make up the complete agreement between you and Cyber Smart Seniors about using our service.

14.2 Modifications

We may change these terms at any time by posting updated terms on our website. Continued use of our service after changes means you accept the new terms.

14.3 Severability

If any part of these terms is found to be unenforceable, the remaining parts will remain in full force and effect.

14.4 No Waiver

If we don't enforce any part of these terms, that doesn't mean we give up that right.

14.5 Assignment

You may not transfer these terms to someone else without our prior written permission. We may transfer these terms without restriction.
